You have to keep your eyes wide open these days. Somebody sent me a link today to the consultation on ports which was also issued on Monday 9th. So I thought I'd have a look to see what other NPS consultations were issued that day but which were dazzled by the coverage of the power generation NPSs.
There was quite a range of NPS related consultations. This appears to be the full list. Some are NPSs. Others are related. Each title is a hyperlink to the consultation document.
1 NPS for Ports - closing date 15th February 2010
2 NPS for Energy infrastructure - closing date 22nd February 2010 and NPSs on Overarching energy NPS, Fossil Fuel, Renewable, Gas and Oil Pipelines, and Electricity Networks and Nuclear .
3 Consultation on regulatory justification decisions on new nuclear power stations - closing date 22nd February 2010
4 Consultation on draft supplementary guidance for s.36 applications: new coal power stations - closing date 1st February 2010
5 Consultation on proposal to transfer the existing Section 37 Electricity Act 1989 Exemptions for Overhead power line consents to the Planning Act 2008 regime - closing date 8th December 2009
A few comments. Firstly these consultations are following the modern practice of asking a specific set of questions. Secondly the thrust is specifically as to whether the statements or regulations fulfill the statutory requirements. Neither of these should however discourage anyone from making points not covered by the questions.
These are the NPSs which the IPC is required to follow. In addition to the consultation, they will in due course be laid before Parliament. If a select committee calls for a debate, the Government is committed to holding that. So political lobbying is not out of place.
1 is as its title suggests, about ports. Note that it has a shorter closing date than power.
2 is about many forms of power, not just nuclear. There is in fact a suite of consultations in there.
3 is about specific nuclear power station designs
4 relates to the need for carbon capture and storage on new coal-fired power station applications
5 is about transferring to the IPC the procedures for exemptions which currently enable electricity network operators to undertake certain minor repair and refurbishment works to electricity transmission and distribution infrastructure in England and Wales without the need to apply to the Secretary of State for formal consent under the Electricity Act.
